Summary

The fight against counterfeiting is an important issue for an intellectual property office, as it guarantees the confidence of users in an intellectual property system. A rigorous fight against counterfeiting requires not only raising awareness but also effective repression. This is what the Bangui Agreement has endeavoured to do by enacting rules ranging from the qualification of acts of counterfeiting to sanctions.

This presentation will provide an opportunity to make a comparative study of the legal rules on counterfeiting in the Bangui Agreement of 1999, some of whose annexes are still in force, and the new Bangui Agreement of 2015, which entered into force on 14 November 2020
