Trademark registrations remain largely dominated by word and figurative marks, but there is a real and growing interest in non-traditional marks.
Based on a conference organized at the National Assembly, this book examines in detail the difficulties encountered by these atypical trademarks. It addresses both the examination of their distinctiveness and the conditions under which this distinctiveness can be acquired through use, particularly in the case of three-dimensional trademarks, position trademarks, pattern trademarks, and color trademarks. It also deals with the issue of their genuine use.
