New Training Program for Technically Qualified Judges of the Unified Patent Court: registration is opened!

The creation of the Unified Patent Court represents a turning point in the history of European intellectual property law. The judges of the Unified Patent Court will be central actors for the success of the Unified Patent Court and the entire patent package.

The Centre for International Intellectual Property Studies, in collaboration with INPI, puts its experience in training public servants, longstanding academic tradition and partnership with key international intellectual property organizations at the service of a training program intended to meet the needs of a crucial collective such as the judiciary, more particularly, go to site technically qualified judges.

The first edition of this new training program, in cooperation with the French National Institute of Industrial Property (INPI), will take place from September to November 2015 in Strasbourg, CEIPI:

1st module: 24, 25 and 26 September 2015

2nd module: 29, 30 and 31 October 2015

3rd module: 19, 20 and 21 November 2015

CEIPI Summer School on Intellectual Property in Europe - 2015

For the 7th consecutive year, CEIPI will organise a Summer School on IP in Europe. The courses will take place from viagra en pharmacie suisse 2 to 10 July, 2015.

Lecturers are chosen from the CEIPI staff and intellectual property specialists including academics, specialised practitioners and professional representatives.

The summer school aims to provide an academic and practical overview of the IP-related aspects of the legal system in the European Union, as well as to shed light on the litigation of intellectual property rights (especially patents) in Europe. The course is intended mainly for students and practitioners who want to acquire the basics of the European IP system.

CEIPI/WIPO/INPI Advanced Course on Intellectual Property, Technology Transfer and Licensing, 15 to 26 June 2015, Strasbourg

PARTNERSHIPS

Signature of the Annual Convention 2015 implementing the agreement between the CEIPI and INPI

CEIPI and INPI signed in 2014 an agreement to strengthen their cooperation in the legal training of intellectual property and to develop common areas of research.

As part of this collaboration, CEIPI and INPI have decided to implement several activities, by means of annual conventions. The annual convention 2015 was signed on 5th June 2015, during the last Administrative Board of CEIPI, held in Strasbourg.

The two partners will develop several projects in 2015, including:

- the training Program for Technically Qualified Judges of the Unified Patent Court (see above)

- the CEIPI/WIPO/INPI Advanced Course on Intellectual Property, Technology Transfer and Licensing, intended to senior officials of national intellectual property offices in developing countries (see above).

Agreement with the Spangenberg Center for Law, Technology & the Arts, Case Western Reserve University School of Law

CEIPI has signed an international cooperation agreement with Spangenberg Center for Law, Technology & the Arts, Case Western Reserve University School of Law, on May 6th, 2015 in Strasbourg, during a ceremony organized by CEIPI.

The signing took place in the presence of Mr. Christophe Geiger, Director General of CEIPI, Mr. Craig Nard, Director of the Spangenberg Center for Law, Technology & the Arts and members of the Research Department of CEIPI.

The objective of this agreement is to develop joint training programs and research, publications and joint organization of conferences and events.

The ceremony took place following a research seminar on the topic: “Non-Practicing Entities' and patent reform in the US”, during which Mr. Nard intervened (see below).

RESEARCH ACTIVITIES

Visiting Professors and Researchers

Dr. Rebecca Giblin, Associate Professor at Monash University School of Law (Melbourne, Australia), has been visiting CEIPI in May 2015 to accomplish research and participate in CEIPI research activities, such as the Roundtable on International IP Law held on May 11th (see below). Among other projects evolving around legal and social aspects of copyright, inter alia the concept of “public interest”, she has advanced on the global collaboration, led in conjunction with Associate Professor Kimberlee Weatherall, Associate Professor at Sydney University, asking “What if we could reimagine copyright?”, formally launched last year during their visit to CEIPI. She has also completed a year long collaboration with Professor Jane Ginsburg of Columbia Law School dealing with the controversy over Aereo and the “making available” right. Conference “IPrism International Intellectual Property Symposium” organized by Osaka University Intellectual Property Center in partnership with CEIPI

Osaka University Intellectual Property Center organized in partnership with CEIPI and the Center for Advanced Study and Research on Intellectual Property (CASRIP), University of Washington, an international conference on the topic “IPrism International Intellectual Property Symposium”. The conference was held on the 4th of June 2015 at Osaka University Nakanoshima Center.

Very renowned French and Japanese scholars and personalities intervened during the conference including: Mr. Alain Michelet, President of the CNCPI (Compagnie nationale des conseils en propriété industrielle), judge Ryuichi Shitara, President of the Japanese IP High Court, Ms. Aurélia Marie, President of AIPPI France (Association Internationale pour la Protection de la Propriété Intellectuelle), Mr. Shigeki Chaen, Professor at Osaka University,  Ms. Toshiko Takenaka, Professor at the Washington School of Law and Mr. Yann Basire, Associate Professor at the University of Haute Alsace and member of CEIPI Research Department.

One-day seminar of the CEIPI’s Research Department: “Intellectual Property at the Court of Justice of the European Union”, May 18th, 2015

A one-day seminar titled “Intellectual Property at the Court of Justice of the European Union” was organized by the CEIPI’s Research Department and the Research Federation “L’Europe en mutation”, on Monday, 18th May 2015, under the scientific leadership of Ms. Stephanie Carre and Mr. Franck Macrez, Associate Professors at CEIPI.

As for the previous editions, the members of the Research Department as well as affiliated practitioners have analyzed the recent developments in intellectual property case-law in the European Union. The one-day seminar also opened new perspectives to be pursued in the interest of the coherence and efficiency of the European system of intellectual property in the single market.

This event was open to students, doctoral students, academics and practitioners and is validated in the framework of the continuing vocational training for lawyers.

CEIPI’s international roundtable on the topic: “Intellectual property and access to science and culture: convergence or conflict?”, 11th May 2015

In the context of the lecture series “(Re)thinking Intellectual Property, Fundamental Questions and New Perspectives”, the CEIPI had the pleasure of welcoming an international roundtable on the topic: “Intellectual property and access to science and culture: convergence or conflict?”, which was held on May 11, 2015 at CEIPI.

The speakers included: Mr. Christophe Geiger, Director General of CEIPI; Mr. Carlos Correa, Professor at the University of Buenos Aires, Argentina; Ms. Rochelle Dreyfuss, Professor at the New York University School of Law, United States; Ms. Lea Shaver, Associate Professor at Indiana University, Robert H. McKinney School of Law, United States; Ms. Rebecca Giblin, Associate Professor at the Monash University, Faculty of Law, Australia; Ms. Frédérique Berrod, Professor at the University of Strasbourg; Ms. Peggy Ducoulombier, Professor at the University of Strasbourg; Ms. Mylène Bidault, Human Rights officer at the Office of the High Commissioner for Human Rights (OHCHR), United Nations, Switzerland.

The issue at stake was to define the relationships between IPRs and the right to access to science and culture, established by major Human Rights international instruments. The speakers have explored different options to render this conflict productive in bringing innovative solutions in the field of access to science and technological aid to development, as well as for the access and endorsement of literary and audio-visual culture.

The topic of this roundtable stemmed from the recent Report and ongoing work of the Special Rapporteur in the field of cultural rights, Mrs. Farida Shaheed (http://www.ceipi.edu/index.php?id=14302&L=2#c65705). Several participants to the roundtable have participated in the designing of the latest Report and they presented the conclusions and follow-up thereof to CEIPI students and researchers.

CEIPI Conference: “The OAPI and the issuing procedure of the intellectual property rights” by Paulin Edou Edou

On April 23rd, 2015 took place the conference of Mr. Paulin Edou Edou, Director General of the African Organization of Intellectual Property (AOPI), who gave a presentation on the topic: “The OAPI and the issuing procedure of the intellectual property rights”. CEIPI Students and Researchers were given the opportunity to receive a deep insight into the principles and organization of this most harmonized regional IP system in the world.

Conference CEIPI-CASRIP “Latest developments in Patent Litigation in Europe and the US: Perspectives from the Judiciary”

The CEIPI has organized in collaboration with CASRIP a public conference on Friday March 27, 2015, headed with “Latest developments in Patent Litigation in Europe and the US: Perspectives from the Judiciary”, which took place at the Palais universitaire de Strasbourg.

This conference has gathered judges from various jurisdictions specialized in IP litigation: Former Chief Judge Randall Rader, US Court of Appeals for the Federal Circuit; Judge Maud Gräfin von Keyserlingk, Munich Court of Appeal; Judge Gabriella Muscolo, Former Judge in the Court of Rome, Member of the Enlarged Board of Appeal of the European Patent Office (EPO); Member of the High Italian Authority for Competition and Trust; Alain Girardet, Counsellor at the First Civil Chamber of the Supreme Court of France.

Moreover, Mr. Pierre Véron, Attorney-at-Law specialized in IP and Member of the “Legal Working Group of the Preparatory Committee on the Rules of Procedure for the Unified Patent Court” has given a presentation about the last conclusions of the Preparatory Committee. Mr. Christophe Geiger, Director General of CEIPI, discussed the complex interaction of the CJEU with the Unified Patent Court and Mr. Xavier Seuba, Senior Researcher at CEIPI, has presented the Training of the Judges of the Unified Patent Court and the implications of having technical judges.

Research seminars of CEIPI’s Research Department

CEIPI develops its research activities, particularly through seminars held regularly under the supervision of Ms. Stéphanie Carre, Associate Professor at CEIPI, University of Strasbourg. The sessions are open to researchers’, PhD students and PhDs of CEIPI, and others researchers.

These seminars allow the members of the research team and doctoral students to meet and to discuss issues related to intellectual property. The objective of these seminars is to stimulate and create synergy between researchers of the Centre.

The sessions of the 2014-2015 academic year were held on:

  •  19th January 2015, dedicated to the presentation of the work of Mr. Jean-Baptiste Varoqueaux, Doctoral student at CEIPI under the supervision of Ms. Stéphanie Carre, on the open innovation, standards and IP law.
  • Ÿ18th February 2015, Mr. Oleksandr Bulayenko, Research assistant and Doctoral student at CEIPI, under the supervision of Mr. Christophe Geiger spoke on the topic: “Collective Management of Copyright for Online Use of Music: Towards Multi-Territorial and Multi-Repertoire Licensing in the EU”.
  • Ÿ16th March 2015, Ms. Elena Izyumenko, Research assistant and Doctoral student at CEIPI, under the supervision of Mr. Christophe Geiger, spoke on the topic: “European “Fair Use” grounded in Freedom of Expression”.

TRAINING AND EDUCATION

Debate of the students from the LLM in European and International IP Law at the European Parliament, with the MEP Julia Reda on the future of copyright: 8th June 2015

During the last plenary session of the European Parliament, students of the M2 (LLM) in European and International IP Law visited the seat of this institution in Strasbourg, accompanied by Mr. Christophe Geiger, Director General of CEIPI, in charge of the LLM diploma. They have met MEP Julia Reda, who is the rapporteur to the Committee on Legal affairs of the European Parliament on the implementation of Directive 2001/29/EC of the European Parliament and of the Council of 22 May 2001 on the harmonization of certain aspects of copyright and related rights in the information society, and were able to discuss freely with her about the draft report.

They also assisted to the plenary discussions over two other reports of major importance for the future of IP in the EU, prepared by MEP Alessia Maria Mosca regarding the strategy for the protection and enforcement of intellectual property rights in third countries and the report of the MEP Pavel Svoboda, on the Communication by the Commission titled “Towards a renewed consensus on the enforcement of Intellectual Property Rights: An EU Action Plan”.

26th European tutors’ meeting of CEIPI

On 28th and 29th May 2015, the CEIPI has organized the 26th annual meeting of its European tutors, teaching on the basic training courses in European Patent Law and on the preparation courses for the European Qualifying Examination. Approximately 80 specialists in European Patent law, coming from several European countries, have participated in this meeting to share their experience and to attend various presentations on European Patent Law.

Ms. Laurence Brüning-Petit, lawyer for patent law at the European Patent Office (EPO), has reported on witnesses’ hearing in oral proceedings before the EPO. Mr. Derk Visser, European patent attorney and CEIPI tutor, author of the “Annotated European Patent Convention”, has given an updated overview of recent EPO case law.

Mr. Quan-Ling Sim, head of PCT outreach and user relations section of the World Intellectual Property Organization (WIPO) have presented PCT updates.

Mr. Xavier Seuba, Senior Researcher at CEIPI and CEIPI-BETA project coordinator has focused on the forthcoming CEIPI training of the technically qualified judges of the Unified Patent Court. Mr. Théo Hassler, professor at the CEIPI, has given an introduction to plant breeders’ right. The meeting has been chaired by Mr. Thierry Debled, Director of the international section of the CEIPI and Associate professor, and Mr. Christophe Geiger, Director General of CEIPI.

At this occasion, Mr. Pieter Spierenburg received a distinction in recognition for his more than 20 years activity as coordinator of the Zurich basic courses.

University Diploma on Patent Litigation in Europe

The 12th course on Patent Litigation in Europe finished on Monday 8 June 2015 with the final oral examination followed by a certificate handout ceremony. This course, which is coordinated by Mr. Walter Holzer, former president of the epi, Mr. Harald Springorum, German and European patent attorney, lecturer at the Heinrich-Heine University Düsseldorf, and Ms. Kiani Nassim, specialized lawyer for intellectual property law, has been followed in 2014-15 by 101 European Patent Attorneys.

During the last module, held in April 2015, the participants have attended a Mock trial chaired by Prof. Dr. Peter Meier-Beck, Presiding judge at the German Federal Court of Justice, Dr. Klaus Juffernbruch, Physician and coach for Human Resources, Mr. Gabriele Gislon, European Patent Attorney, Mr. Harald Springorum and Ms. Nassim Kiani.

CEIPI at the 9th Advanced Intellectual Property Research Forum of WIPO, Geneva

From May, 26 to 28, 2015, the CEIPI participated at the 9th Advanced Intellectual Property Research Forum of WIPO in Geneva on the topic “Towards a Flexible Application of Intellectual Property Law – A Closer Look at Internal and External Balancing Tools”.

Mr. Jean Lapousterle, Professor of private law and criminal sciences at the University of Strasbourg and member of the Research Department at the CEIPI, has participated in the “Rendez-Vous de 5 heures” organized by the Association IP Assas Master 2 Droit de la Propriété Littéraire, Artistique et Industrielle, hosted by Hermès, Kering, Linklaters and TF1, which took place in Paris from May 26 to 28 on the topic: « L'étude critique des réformes récentes et textes à venir en propriété intellectuelle ».

Mr. Lapousterle spoke on May 27 on the topic: « Les singulières réformes de la durée des droits et du statut des œuvres orphelines ».

CEIPI at the second part of the 16th EIPIN Congress in Munich

The 16th EIPIN Congress entitled “The Innovation Society and Intellectual Property” took place from 9th to 11th April 2015 at the European Patent Office in Munich (Germany).

Mr. Christophe Geiger, Director General of CEIPI, chaired and commented the panel dedicated to “Enhancing creativity through copyright exceptions and limitations – in the interest of authors and users”. 

The CEIPI was also represented by two doctoral candidates who presented their work at the EIPIN Doctoral meeting at the Max Planck Institute for Innovation and Competition that will precede the conference: Mr. Leonardo Machado Pontes “Trade Mark Law – an Inquiry into the Merits of Proper Internal and External Boundaries”, and Ms. Teresa Calixto-Lopez “Socially responsible licensing in the area of green technologies”.

Annual meeting of the European Copyright Society hosted by CEIPI

On May 23, 2015, CEIPI hosted the annual meeting of the European Copyright Society (ECS). Its Members took stock of the latest initiatives and achievements of the Society, established the work plan for the year to come and took a number of important decisions for the society’s future.

At the end of the meeting, the Chair of the ECS was transferred from Christophe Geiger, Associate Professor and Director General of CEIPI, to Lionel Bently, Professor and Director of Centre for Intellectual Property and Information Law of the University of Cambridge. The new Board of the society is composed of: Lionel Bently, Centre for Intellectual Property and Information Law (CIPIL), University of Cambridge; Christophe Geiger, Centre for International Intellectual Property Studies (CEIPI), University of Strasbourg ; Séverine Dusollier, Science Po Paris and University of Namur.

The European Copyright Society (ECS) was founded in January 2012 with the aim of creating a platform for independent scholarly thinking on European Copyright Law. Its members are scholars and academics from various countries of Europe, seeking to promote their views of the overall public interest regarding the construction of European Copyright law.

Most recently, the ECS released an Opinion on limitations and exceptions to copyright in the European Union based on the Judgement of the Court of Justice of the European Union of September 3, 2014 in Case C-201/13 Deckmyn and an Open letter to the European Commissioner for Digital Economy and Society, inviting the European Commission to start working on a unified copyright law for the European Union. CEIPI partner of the “Global Forum on Intellectual Property 2015” organized by Intellectual Property Academy (IPA) of Singapore

In the framework of its partnership with the Intellectual Property Academy (IPA) of Singapore, CEIPI and IPA join forces for the organization of the Global Forum on Intellectual Property 2015 (GFIP) on the topic “Simple Past, Present Continuous...Future Perfect?” to be held in Singapore, on 25 – 26 August 2015. GFIP 2015 is also the anchor event of IP Week @ SG 2015, organized by the Intellectual Property Office of Singapore (IPOS).

Doctoral contract at CEIPI on the topic European patent with unitary effect and on the European Patent Court

Within the framework of a partnership between the CEIPI, the INPI and the ACPI (Association des Conseils en Propriété Industrielle), we are looking for a legal scholar with a Master’s degree or an LLM in intellectual property who wishes to pursue doctoral studies in intellectual property and write a thesis (in French) on the European patent with unitary effect and on the European Patent Court.

Internship offer: Legal Researcher in Human Rights and Intellectual Property

The CEIPI (Centre for International Intellectual Property Studies) is looking for a legal intern to advance the educational and research missions of the center.

The intern will work with Christophe Geiger (Director General and Director of the Research Department of the CEIPI) on a research project on Human Rights and Intellectual Property. The intern will research the case law with regard to fundamental rights implications of intellectual property. Excellent research and drafting skills are required.
