Mr. Antonio CAMPINOS, new President of the CEIPI’s Administrative Board

Antonio CAMPINOS, President of the Office for Harmonization in the Internal Market (OHIM) and ex officio member of the Board officially took office as the new President of the CEIPI’s Administrative Board. He succeeds go Francis GURRY, Director General of the World Intellectual Property Organization (WIPO). The members of the Board unanimously offered their warm congratulations to Mr. CAMPINOS and wished him every success.

Of Portuguese nationality, Mr. CAMPINOS studied at the universities of Montpellier and Nancy and held positions in the public administration sector in Portugal.

Due to his vast international experience in the intellectual property field, Mr. CAMPINOS became Head of the Portuguese National Institute of Industrial Property in 2005. He was Chairman of the Ad Hoc Working Group on the Legal Development of the Madrid System for the International Registration of Marks at the World Intellectual Property Organization (WIPO) between 2005 and 2008. Mr. CAMPINOS was member of the Administrative Council of the EPO from 2005 to 2010, and Chairman of the Administrative Board of the OHIM in 2007 before being appointed as its President on October 1, 2010.

Following the board meeting of the CEIPI on July 7, 2013, a transfer of power ceremony was organized to sincerely thank Francis GURRY for his considerable achievements as head of the Administrative Board since 2009.

Signature of a cooperation agreement between the WIPO and the University of Strasbourg (CEIPI)

A cooperation agreement between the World Intellectual Property Organization (WIPO) and the CEIPI was signed at the latest board meeting of the CEIPI that took place on http://bibliotheksverband.de/?drogerie=cialis-kaufen-internet&92b=57 7 June 2013 in Strasbourg.

This agreement reinforces an enduring cooperation between CEIPI and WIPO, established in 1978, which has enabled (in cooperation with the French INPI) the training of senior civil servants of industrial property offices of developing countries, of least developed countries and of countries in transition. The reinforcement of human resources specialized in intellectual property in these countries will be improved by the joint organization of an annual advanced course designed for government officials.

Through this agreement, the two institutions aim to reinforce their cooperation in education and training in the field of intellectual property with the aim of responding to the needs of developing countries, of least developed countries and of countries in transition. Training seminars for the judiciary will also be implemented.

The CEIPI and the WIPO will regularly exchange information on their respective programs and will consult each other regularly so as to optimize their education and training programs in the field of intellectual property.

CEIPI Summer School on Intellectual Property in Europe

For the 5th year, the CEIPI organized a Summer School on IP in Europe. The courses were held  viagra apothekenpreise from July 01 to July 06, 2013.

This Summer School aims to provide an academic and practical overview of the IP-related aspects of the legal system in the European Union, as well as giving concrete ideas about IP litigation in Europe. End of the Academic Year 2012-2013

The closing ceremony of the academic year for the "Patents" and the "Trademarks and Industrial Designs" tuition took place on June 28, 2013 with the traditional ceremony of communication of results followed by the farewell party gathering some of the lecturers (Francis Ahner, Yann Basire, Axel Casalonga, Xavier De Beaufort, Me François Greffe, Laurent Nuss, Emmanuel Py and Gérard Weiss), students and the CEIPI team (Christophe Geiger, Yves Reboul, Stéphane Thomas, Céline Meyrueis).

This year, the best students received gifts offered by the INPI (Institut National de la Propriété Industrielle), represented by Caroline Rolshausen, Regional Delegate of INPI Alsace and by the ASPI (the French Association of Industrial Property Specialists of the Industry), represented by its President, Philippe Conan.

WIPO/CEIPI/INPI Advanced Training Course on the Legal, Economic and Management Aspects of Intellectual Property

From June 10 to 21, 2013, took place the annual WIPO/CEIPI/INPI Advanced Training Course on the Legal, Economic and Management Aspects of Intellectual Property.

Jointly organised by the World Intellectual Property Organization
(WIPO), the Centre for International Intellectual Property Studies (CEIPI) and the French National Institute of Industrial Property (INPI) since 1978, this training is addressed to officials of national and regional intellectual property offices of developing countries, least developed countries (LDCs) and countries with economies in transition, and it is aimed at building their human capacity as well as enhancing the awareness of the intellectual property rights’ implications for development.

This year, 13 participants from four continents (Europe, Africa, Central America and Asia) were present. During the course of these two weeks, they could share their experience and knowledge in the field of intellectual property.

CEIPI/epi Basic Training Course

The CEIPI is strengthening its training activity in the field of European Patent Law by jointly organizing with the epi a new basic training course in the Czech Republic (Prague) as from October 2013.

Training courses for the European Qualifying Examination 2014

The international section of the CEIPI provides training for the European Qualifying Examination 2014 (pre-examination and main examination). The training includes introductory courses in the early autumn of 2013 in different cities in Europe, followed as from November 2013 by seminars preparing for the pre-examination and for papers ABCD of the main examination. This programme is completed by a special C course for re-sitters in November 2013 and by last-minute cramming courses in late January 2014.

24th International Meeting of the CEIPI Tutors

On 2 and 3 May 2013, the CEIPI organized in Strasbourg the 24th meeting of its tutors of the International Section. More than 50 experts in European Patent Law coming from all over Europe attended this meeting in order to share their experience and to attend conferences held by specialists in European and International patent law.Several lecturers renowned for their expertise in the field of patent law participated in the meeting. Matthias Reischle, Deputy Director of the PCT Legal Division of the World Intellectual Property Organization (WIPO), gave an updated presentation on the Patent Cooperation Treaty (PCT). Daniel Thomas, former director of DG 1 of the European Patent Office (EPO) and CEIPI tutor, presented norms and standards in patent procedures and patent documents. Derk Visser, European patent attorney and CEIPI tutor, author of «The Annotated European Patent Convention», gave an updated presentation of recent EPO case law. Francis Leyder, chairman of the European Patent Practice Committee of the epi, and Mihaela Teodorescu, vice-president of the epi and coordinator of the Bucarest course, gave an introduction to procedural aspect of the Unitary Patent before the EPO and to future changes within the basic training programme.

Enrolment to the CEIPI courses leading to diplomas - Academic year 2013/2014

Enrolment to the accelerated tuition in "Patents" and "Trademarks and designs" is open. Deadline for enrolment is 31 August 2013.

Written tests for candidates to the "Accelerated Tuition" in Patents will take place in Paris:

- Tuesday, 10 September 2013 in the aternoon for the candidates specialized in mechanics and others.
- Thursday, 12 September 2013 in the morning
for the candidates specialized in chemistry and biology.

The exact address will be announced later on the CEIPI website. Each candidate will receive a notice in early September.

Enrolment to other CEIPI courses leading to diplomas for the Academic year 2013/2014 is now closed.

RESEARCH ACTIVITIES

Rebecca Giblin, Visiting scholar at CEIPI in July 2013

Dr Rebecca Giblin, a Senior Lecturer at Monash University in Australia, has been visiting CEIPI in July. During her time at the centre, Rebecca finalised several projects relating to the global "graduated response" to copyright infringement, particularly the French HADOPI law. She also spent time drafting submissions regarding the future of copyright limitations in Australia, and planning an international workshop to be held in Strasbourg at the CEIPI next year.

Reply of the CEIPI to the European Commission's survey on the civil enforcement of intellectual property rights

You can download the reply of the CEIPI to the European Commission's public consultation for the purpose of gathering specific information on the efficiency of proceedings and accessibility of measures in the context of civil enforcement of intellectual property rights.

The CEIPI puts the accent on ADR (alternative dispute resolution), a mechanism which so far had not been sufficiently recognized as an efficient tool within the European legal framework for the intellectual property rights enforcement.

From April 5 to 7, 2013, the CEIPI organized and hosted the Congress of the European Intellectual Property Institutes Network (EIPIN) on the topic: "Human Rights and Intellectual Property: From Concepts to Practice".

The conference was organized under the academic direction of Christophe Geiger, Associate Professor, Director General and Director of the Research Department of CEIPI.

The European Patent System stands at crossroads. Although an agreement on a European Union patent was expected, the creation of such an instrument ran up against several difficulties. As a consequence, the implementation of a European patent with “unitary effect” through the mechanism of enhanced co-operation was decided. At the same time, the Court of Justice of the European Union (the CJEU) issued a negative opinion on the legislative proposals to create a European Patent Court which, in turn, led to the adoption of a revised text that sparked major debates. The need to reflect on the future of the patent system in the European Union is felt as never before.

In this context, the Centre for International Intellectual Property Studies (CEIPI) brought together renowned academics, eminent professionals, judges, and institutional representatives active in the field of intellectual property for a conference on the topic “What Patent Law for the European Union?” held on 26 and 27 April 2012 at the European Parliament in Strasbourg.

This book presents the results of this important event and proposes areas for further consideration with a view to the development of an effective and balanced legal and judicial framework for patents within the European Union.

This book is up to date with the Regulation (EU) N° 1257/2012 of 17 December 2012 implementing enhanced cooperation in the area of the creation of unitary patent protection and the Council Regulation (EU) N° 1260/2012 of 17 December 2012 implementing enhanced cooperation in the area of creation of unitary patent protection with regard to the applicable translation arrangements.

Publication in the CEIPI Collection: "The contribution of case-law to the construction of the intellectual property in Europe"

The CEIPI and its Research department are pleased to inform you about the publication of a new volume in the CEIPI collection (Lexis-Nexis-Litec Edition) edited by Christophe Geiger, Director General of the CEIPI, entitled:

"The contribution of case-law to the construction of the intellectual property in Europe".

The elaboration of European Intellectual Property Law is a work in progress. The Courts of the European Union, as well as the Boards of Appeal of the various European and Community Offices, are increasingly being asked to interpret different concepts of European law. Thereby, they contribute substantially to defining the contours of this emerging legal framework and are thus an important channel for harmonization. However, the guidelines provided by judges are not always clear, making it sometimes difficult to understand the exact scope of European Intellectual Property Legislation.

The aim of this collective work is to attempt an analysis of such case-law and to highlight its contribution to the European construction of copyright law, design law, trademark law (especially with regard to keywords advertising), patent law (in particular concerning the notion of patentable invention), plant varieties protection, geographical indications, and enforcement of intellectual property rights. The increased use of competition law and of fundamental rights in EU case-law in the field of intellectual property will also be addressed.

Yann Basire´s PhD thesis is published on OHIM website: "The functions of a Trade Mark: Essay on the Coherence of the Legal Regime Governing a Distinctive Sign"

OHIM's (Office for Harmonization in the Internal Market) University Network, which encompasses 23 European Universities, brings together Intellectual Property students and researchers from across the European Union.

The University Network, part of the OHIM Academy, has published the first PhD thesis from one of its network members on its website: "The functions of a Trade Mark: Essay on the Coherence of the Legal Regime Governing a Distinctive Sign" by Dr Yann Basire, Associate Professor at the University of Orléans.

Yann Basire defended his thesis at the CEIPI on December 6, 2011, under the supervision of Professor Yves Reboul, Director of the French section at the CEIPI.

PARTICIPATION OF THE CEIPI TEAM TO SYMPOSIUMS, CONFERENCES AND OTHER EVENTS

Christophe Geiger, Director General of the CEIPI, at the 4th Global Forum on Intellectual Property (GFIP) in Singapore

Christophe Geiger, Director General of the CEIPI, will participate in the 4th Global Forum on Intellectual Property (GFIP) to take place in Singapore from August 27 to 28, 2013.

On August 27, Christophe Geiger, will take part in the panel "Copyright in the 21st Century: The End of Copyright as We Know It?"

This trip will be an opportunity for the Director General to sign an important cooperation agreement with the IP Academy of Singapore on the training and research in the field of intellectual property.

Christophe Geiger, Director General of the CEIPI, at the 5th Annual ISHTIP Workshop on "Cultural Economy and Intellectual Property"

Christophe Geiger, Director General of the CEIPI, participated in the 5th Annual ISHTIP (International Society for the History and Theory of Intellectual Property) Workshop on "Cultural Economy and Intellectual Property". This event took place in Paris from June 26 to 28, 2013.

On June 26, Christophe Geiger commented on a paper presented during the  session "Industry Practices and IP Norms".

And on June 27, he chaired the session "National and International Organizations".

Christophe Geiger, Director General of the CEIPI, at the 32nd Annual ATRIP Congress in Oxford on the topic "Is Intellectual Property a Lex Specialis?"

Christophe Geiger, Director General of the CEIPI, participated in the 32nd Annual ATRIP (International Association for the Advancement of Teaching and Research in Intellectual Property) Congress which took place in Oxford from June 23 to 26, 2013 on the topic: "Is Intellectual Property a Lex Specialis?".

On June 25, Christophe Geiger delivered a presentation on the topic: "Intellectual Property and Constitutional Law in the EU after the Treaty of Lisbon: Time to Revise Article 17 (2)".

Laure Marino at the workshop on patent laws: "Les nouveaux usages du brevet d'invention : entre innovation et abus" organized by the Law Faculty of Aix-en-Provence

Laure Marino, Professor in the Law Faculty of the University of Strasbourg and member of the CEIPI's Research Department, participated in the workshop on patent laws: "Les nouveaux usages du brevet d'invention : entre innovation et abus" organized by the Law Faculty of Aix-en-Provence, on May 31, 2013 from 09.00 am till 05.00 pm, under the supervision of Jean-Pierre Gasnier and Nicolas Bronzo.

She delivered a presentation on the patent thickets.

The CEIPI participated to the 7th Advanced Research Forum on Intellectual Property Rights, entitled "Harmonization in Intellectual property Law - New Perspectives and Dimensions", organized by the WIPO (World Intellectual Property Organization) held in Geneva from May, 28 to 30, 2013.

On May 28, Xavier Seuba, Senior Associate Researcher at CEIPI, spoke about "The Codification of Intellectual Property Enforcement via Commercial Agreements: towards Harmonization or Conflict?",

On May 28, Pablo Mohr, Phd Candidate at CEIPI, spoke about "Harmonizing Copyright Transmissions in Europe: Towards a new Framework for Copyright Contract Law? A comparative study based on the national laws of England, France, Germany and Spain",

On May 30, Natalia Kapyrina, Phd Candidate and Research Assistant at CEIPI, spoke about "A European Perspective on International Industrial Design Law Harmonization".

Evelyne Roux new President of the AACEIPI (Association des Amis du Centre d'Etudes Internationales de la Propriété Intellectuelle)

On the 4thof July 2013, the Management Board of the AACEIPI (Association des Amis du Centre d'Etudes Internationales de la Propriété Intellectuelle) appointed Evelyne Roux, Patent and Trademarks Attorney and Lecturer at the CEIPI, as President of the Association, along with Nathalie Varin, Vice-President, Jean-Nicolas Heraud, Secretary and Céline Silva, Treasurer.

"With the help of everyone who would like to join us, we will work towards reinforcing the presence of the Association among students, develop an active social network and re-establish contact with former students of the CEIPI who now live abroad."

"We hope to continue the work of Philippe Chêne and of those who worked with him and to contribute to the standing and the importance of the CEIPI by assisting all those who are crucial to its success." (Evelyne Roux).

Marrakesh Treaty to Facilitate Access to Published Works for Persons who are Blind, Visually Impaired, or otherwise Print Disabled

Between 17 and 28 June 2013, WIPO (World Intellectual Property Organization) organized in Marrakesh (Morocco) a diplomatic conference which concluded with the adoption of the Marrakesh Treaty to Facilitate Access to Published Works for Persons who are Blind, Visually Impaired, or otherwise Print Disabled.

ECTA first prize for a CEIPI’s student of the Master in European and international Intellectual Property Law, directed by Christophe Geiger

We are happy to announce that M. Garry Trillet, student of the Research Master “European and International Intellectual Property Law”, directed by M. Christophe Geiger,  received on June 21, 2013 in Bucharest, the first prize of the European Communities Trade Mark Association (ECTA) in the student category for his work entitled “Registrability of smells, colors and sounds: How to overcome the challenges dressed by the requirements of graphical representation and distinctiveness within European Union Law?”.

ECTA was formed in 1980. ECTA numbers 1500 members, coming from all the Member States of the European Union and associate members from all over the world. It brings together persons dealing professionally with trade marks (Lawyers, trade mark advisors, specialist practitioners in these areas).
